Tariffik is a commodity code lookup tool operated from Jersey, Channel Islands. The service uses artificial intelligence to analyse product information and suggest Harmonized System (HS) tariff codes for customs purposes.

2. Important Disclaimer About Commodity Codes

You acknowledge that using an incorrect commodity code may result in:

• Customs delays or seizure of goods
• Incorrect duty rates being applied
• Penalties or fines from customs authorities
• Additional charges or assessments

Tariffik is not liable for any consequences arising from the use of suggested commodity codes.

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorised use

3.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these terms or are used for abusive purposes. You may delete your account at any time.

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to circumvent rate limits or access restrictions
• Interfere with or disrupt the service or its infrastructure
• Use automated scripts or bots to access the service (except via official APIs, if provided)
• Impersonate another person or entity
• Submit false, misleading, or fraudulent information
• Use the service to facilitate customs fraud or evasion

5. Email Forwarding

When you forward emails to your unique Tariffik address, you confirm that:

• You have the right to share the email content with us
• The emails relate to your own orders or orders you are authorised to manage
• You will not forward emails containing sensitive personal information about third parties without their consent

6. Intellectual Property

The Tariffik service, including its design, features, and content (excluding user-submitted data), is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our service without permission.

You retain ownership of any data you submit to the service. By using Tariffik, you grant us a limited licence to process your data solely for the purpose of providing the service.

7. Third-Party Services and Data

Tariffik uses data from third-party sources, including:

• UK Trade Tariff API - Official HMRC tariff data
• Retailer websites - Product information scraped from URLs you submit
• AI services - For generating commodity code suggestions

We are not responsible for the accuracy of data from third-party sources.

8. Service Availability

We strive to maintain service availability but do not guarantee uninterrupted access. The service may be temporarily unavailable due to:

• Scheduled maintenance
• Technical issues or outages
• Third-party service disruptions
• Circumstances beyond our control

9. Limitation of Liability

To the fullest extent permitted by law:

• The service is provided "as is" without warranties of any kind, express or implied
• We do not warrant that commodity code suggestions will be accurate, complete, or suitable for your purposes
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid to use the service (currently zero, as the service is free)

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless Tariffik and its operators from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these terms
• Your use of commodity codes in customs declarations
• Any claim that your use of the service infringes third-party rights

11. Changes to Terms

We may modify these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms. We will make reasonable efforts to notify users of significant changes.

12. Governing Law and Jurisdiction

These terms are governed by the laws of Jersey, Channel Islands. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Jersey.

13. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
